Is Medical Marijuana Legal in PA?

Medical marijuana was legalized in Pennsylvania on April 6, 2016 and became available in the state on February 15, 2018. To get a card, you must suffer from one of the qualifying conditions.

Pennsylvania Medical Cannabis Requirements

According to Pennsylvania medical marijuana laws, you must be at least 18 years of age to get a medical marijuana card. Besides having one of the qualifying conditions, you should be able to prove state residence with a valid driver’s license or state-issued ID card. 

Parents can register as approved caregivers for those who are under 18 years of age and have one of the conditions that is approved to be treated by medical marijuana and buy it for their children. If you are not the parent, legal guardian, or spouse of the person you will be purchasing for, you will need to be designated as a third-party caregiver by the patient before applying for a medical marijuana card. 

If you do not have a medical marijuana card or if you have a card and do not buy your marijuana from a licensed dispensary in the state, you are committing a crime and can be punished. In Pennsylvania, possession of 30 g or less of marijuana can result in a $500 fine and up to 30 days in jail while anything over 30 g is a felony and can incur penalties of up to $15,000 and 3.5-5 years of jail time.
